Terms of Service

Welcome to Tantradvisor. These Terms of Service (“Terms”) govern your access to and use of our platform, services, and website (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, browsing events, registering for events, or listing events as a teacher, you agree to these Terms, our Privacy Policy, and Cookie Policy. If you do not agree, you may not use the Service.

You must be at least 18 years old to use this Service. By using Tantradvisor, you represent and warrant that you meet this age requirement.

2. User Accounts

Account Creation

  • You must provide accurate, complete, and current information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You agree to notify us immediately of any unauthorized access to your account.
  • You are responsible for all activities that occur under your account.
  • One person or entity may not maintain multiple accounts without our prior written consent.

Account Types

  • Participant Accounts: Register for events, leave reviews, and manage bookings.
  • Teacher Accounts: Create and manage events, screen participants, and receive payments.
  • School Accounts: Manage institution profiles and affiliated teachers.

Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or conduct harmful to our community. You may close your account at any time through your account settings.

3. Event Listings (For Teachers)

Content Standards

As a teacher listing events on Tantradvisor, you agree to:

  • Provide accurate, honest, and complete event descriptions
  • Honor the pricing, dates, and terms stated in your event listings
  • Maintain appropriate credentials and qualifications for the teachings you offer
  • Create a safe, respectful, and professional environment for participants
  • Not misrepresent your experience, credentials, or the nature of your events
  • Comply with all applicable laws and regulations, including licensing requirements

Prohibited Content

You may not list events that:

  • Involve illegal activities or services
  • Promote hate, discrimination, or violence
  • Include sexually explicit content beyond educational tantra teachings
  • Make false or misleading health claims
  • Violate the intellectual property rights of others
  • Breach confidentiality or privacy of individuals

Screening and Approvals

Teachers may require pre-event screening calls with participants. If you implement screening, you must:

  • Respond to screening requests within 48 hours
  • Conduct screenings professionally and respectfully
  • Approve or decline registrations within 72 hours of screening
  • Not discriminate based on protected characteristics (race, religion, gender identity, etc.)

4. Event Registration and Payments

For Participants

  • Registration constitutes a binding commitment to attend the event (subject to cancellation policies).
  • Payment is processed immediately for events without screening, or after teacher approval for screened events.
  • You agree to provide accurate payment information and authorize the charges.
  • All payments are processed through our payment provider (Stripe) and subject to their terms.

For Teachers

  • You must connect a Stripe account to receive payouts.
  • Platform fees (5-10% depending on subscription tier) are deducted from event proceeds.
  • Payouts are transferred within 2 business days after an event concludes.
  • You are responsible for all taxes on your event income.

Refunds and Cancellations

  • Participant Cancellations: Refunds are subject to the cancellation policy set by the teacher for each event.
  • Teacher Cancellations: If a teacher cancels an event, participants receive full refunds including platform fees.
  • Platform Cancellations: We may cancel events that violate these Terms and issue appropriate refunds.
  • Refunds are processed to the original payment method within 5-10 business days.

5. Conduct and Community Standards

All users agree to:

  • Treat other users with respect, kindness, and professionalism
  • Honor commitments and agreements made through the platform
  • Respect personal boundaries and consent at all times
  • Communicate clearly and honestly about expectations and needs
  • Report inappropriate behavior or policy violations to us promptly

Prohibited conduct includes:

  • Harassment, bullying, or threatening behavior
  • Fraudulent activity or misrepresentation
  • Attempting to circumvent platform fees by arranging payments outside the platform
  • Scraping or automated data collection without permission
  • Interfering with platform functionality or security
  • Using the platform for any illegal purpose

6. Intellectual Property

Platform Content

The Tantradvisor platform, including its design, logos, text, graphics, and software, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

User Content

  • You retain ownership of content you upload (event descriptions, photos, reviews, etc.).
  • By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it in connection with the Service.
  • You represent that you own or have rights to all content you post and that it does not violate third-party rights.
  • We reserve the right to remove content that violates these Terms or applicable law.

7. Reviews and Ratings

  • Participants who attend events may leave verified reviews.
  • Reviews must be honest, based on personal experience, and comply with our content standards.
  • Teachers may respond to reviews but may not offer incentives for positive reviews or retaliate against negative ones.
  • We may remove reviews that are fraudulent, defamatory, or violate these Terms.

8. Disclaimers and Limitations of Liability

Platform Role

Tantradvisor is a marketplace platform connecting teachers and participants. We do not:

  • Provide tantra teachings or wellness services ourselves
  • Verify all credentials or qualifications of teachers (though we encourage transparency)
  • Guarantee the quality, safety, or legality of any event
  • Assume responsibility for the conduct of teachers or participants

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TANTRA EVENTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tantradvisor and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your use of the Service
  • Your content or event listings
  • Your conduct as a teacher or participant
  • Your violation of any third-party rights

10. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

Arbitration

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association. You waive the right to participate in class-action lawsuits or class-wide arbitration.

Exceptions

Either party may seek injunctive relief in court to prevent irreparable harm. Small claims court claims may be brought in lieu of arbitration.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice on the platform. Continued use of the Service after such notice constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

12. General Provisions

  • Entire Agreement: These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Tantradvisor.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
  • Assignment: You may not assign these Terms without our consent. We may assign them to any affiliate or successor entity.
  • Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control.
